4.1 Plans: ViralGuideAI offers the following monthly subscription plans billed in US Dollars through Paddle, our authorised Merchant of Record:
4.2 Billing: Subscriptions are billed in advance on a recurring monthly basis. By subscribing, you authorise Paddle to charge your payment method automatically. Subscriptions auto-renew unless cancelled before the renewal date.
4.3 Refunds: Refunds are governed by our Refund Policy. We offer refunds on a case-by-case basis within 7 days of a monthly charge where significant use has not occurred. Paddle acts as Merchant of Record and handles all billing, tax collection, and financial compliance worldwide.
4.4 Cancellation: You may cancel your subscription at any time through your Paddle billing portal. Cancellation stops future charges. Access continues until the end of the paid billing period.

ViralGuideAI, its owners, officers, employees, and agents accept zero liability for any AI-generated content or the consequences of publishing it. The AI is a creative tool, not a professional advisor. Never publish AI-generated content without applying your own judgment, review, and editorial discretion.
6.1 Your Content: You retain ownership of all input data you provide to the Service (topics, niches, descriptions). You grant us a limited, non-exclusive licence to process your inputs solely to provide the Service.
6.2 Generated Content: You own the strategies and content generated for you by the Service, subject to these Terms. However, because AI outputs may be similar across users with similar inputs, we make no guarantee of exclusivity or uniqueness of any generated output.
6.3 Platform IP: The ViralGuideAI platform, including its design, code, branding, and systems, is proprietary. You may not reproduce, distribute, or create derivative works from the platform itself without written permission.
6.4 AI Training: We do not use your generated strategies or personal content to train AI models without your explicit consent.

The Creator Collaboration Directory and Trend Alert Service ("Directory") is a self-serve, neutral discovery platform. ViralGuideAI is not a party to any collaboration, agreement, or transaction made through the Directory.
The Service — including all software, designs, text, graphics, logos, and proprietary content (excluding user-generated content) — is owned by ViralGuideAI and protected by copyright, trademark, and other intellectual property laws worldwide.
You may not copy, modify, distribute, sublicense, or create derivative works from our proprietary content without express written permission from ViralGuideAI.
The Service integrates with third-party providers including Google (authentication), Supabase (database), Anthropic Claude API (AI generation), Paddle (payments), and Vercel (hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices, content, or availability of any third-party service.
ViralGuideAI generates strategies for use on third-party platforms including Instagram, TikTok, YouTube, LinkedIn, and Twitter/X. We are not affiliated with, endorsed by, or connected to any of these platforms. You are responsible for complying with each platform's terms of service and community guidelines.
12.1 Service Availability: The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure access to the Service.
12.2 AI Limitations: Our AI technology may produce unexpected, inaccurate, biased, or unsuitable results. You are solely responsible for reviewing and validating all generated content before use. We accept no liability for AI-generated outputs.
12.3 Liability Limit: To the maximum extent permitted by applicable law, ViralGuideAI's total aggregate liability for any claims arising from your use of the Service shall not exceed the total amount you paid us in the 30 days immediately preceding the claim. We shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages of any kind.
12.4 Indemnification: You agree to indemnify and hold harmless ViralGuideAI and its officers, employees, and agents from any claims, liabilities, damages, and expenses arising from your use of the Service, violation of these Terms, or content you publish using our outputs.
We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable grace period.
You may cancel your subscription at any time through your Paddle billing portal.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes where possible. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found unlawful or unenforceable, that provision shall be severed without affecting the remaining provisions. These Terms, together with our Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and ViralGuideAI regarding the Service.
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India. If you are a consumer in the European Union or UK, you may also be entitled to bring proceedings in the courts of your country of residence under applicable consumer protection laws.
